The FLSA imposes overtime to non-exempt employees only when they work beyond 40 hours in a given workweek.

On the other hand, California employment laws impose overtime to non exempt employees who work:

- beyond 8 hours in a single workday

- beyond 40 hours in a single workweek

- all hours worked on a seventh consecutive workday

Additionally, California provides for a "double time" rate when the hours exceed:

- 12 in a single workday

- 8 on a seventh consecutive workday
