As a general matter, the Fair Labor Standards Act requires employers to pay their employees for overtime work at a rate of one and one-half times the employees' regular rate of pay for all hours worked in excess of 40 in a workweek. The FLSA, however, provides a limited exception to this rule for state and local governmental agencies in that public employers may compensate employees who work overtime hours with extra paid time off instead of overtime pay in certain circumstances.
